Consent to Receive Text Messages

By signing up through our website, You are consenting to receive text messages that may be sent via an automatic telephone dialing system to the mobile number provided from Tinoco Painting, its affiliates or its successors.

Your consent to receive text messages (including promotional and transactional alert text messages, which come from a ten digit phone number) from Tinoco Painting, is subject to these Text Terms, including the Dispute Resolution provisions found below, and also is subject to the Privacy Policy at the link below (collectively referred to herein as the “Agreement”).

You agree that when You consent to receive text messages from any of our text message programs, You will receive confirmatory opt-in text messages from the respective program. You agree to receive opt-out texts from any of our programs if You subsequently reply STOP to any text messages you receive. For help related to any text message program, reply HELP to any text message received. You agree that when You initiate a text message to any of our text message programs, You may receive related text messages in reply.

When opted-in, you will receive text messages (SMS/MMS) to your mobile number. These kinds of messages may include responses to a quote, estimate, or service inquiry, real-time texts to ask and answer questions about our services and pricing, appointment scheduling and confirmations, feedback requests, project updates, marketing messages, and follow-up.
You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for messages sent to you from us and to us from you. The number of messages you can expect to receive per month will vary based on your interaction with us, Tinoco Painting.

What you are consenting to

Our inquiry form carries two separate consent checkboxes. They are reproduced here word for word, because this is the wording you agree to at the point you tick them:

Transactional messages. Replies to a quote request, confirmation of an appointment, a message when a crew is on the way, and anything else about a job you have asked us about.
Marketing and promotional messages. Occasional promotional messages about painting services and seasonal offers. You agree to these by ticking the same box as the messages above — there is one consent, and it covers both.

Age restriction

You must be at least 18 years old to consent to receive text messages from Tinoco Painting, and by consenting you confirm that you are.

Carriers and your mobile number

Please consult Your service agreement with Your wireless carrier to determine Your phone’s pricing plan. This program may not be available on all wireless carriers. The carriers supported by this program are AT&T, Boost Mobile, Sprint, T-Mobile, U.S. Cellular, and Verizon, but Tinoco Painting may add or remove any wireless carrier from this program without notice.

You warrant that You have provided Your accurate mobile telephone number to Tinoco Painting and that You have authority to consent to receive text messages at that number. Before changing, deactivating, or relinquishing Your mobile phone number, You agree that You will opt-out of Tinoco Painting text message programs, or text message programs offered by our other brands which You may have signed up to receive. Failure to do so constitutes a material breach of these Text Terms.

You agree that Tinoco Painting may change these Text Terms from time to time, through updating the online version of these Text Terms. Should there be a material change to these Text Terms, Tinoco Painting will provide notice of such change via text messaging.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of them will be brought in the courts located in California.

Our Services

Tinoco Painting provides the services described on this website. The specific work, price, and schedule for your job are set out in the quote, estimate, or written agreement we provide for that job, which together with these Terms forms the agreement between us. Descriptions and any figures shown on this website are general information, not a binding quote. Scheduling depends on availability, weather, parts and material lead times, and other factors outside our control, so any dates we give are estimates and can change. If the scope of the work changes, or conditions are found once work begins that we could not see beforehand, we will discuss any change to price or timeline with you before continuing.

Use of This Website

You may use this website for lawful purposes only — to learn about our services and to contact us. You agree not to misuse it, attempt to gain unauthorized access to any part of it, interfere with its operation, scrape or copy it by automated means, or use it in any way that could harm Tinoco Painting or anyone else.

Unless stated otherwise, the content on this site — text, graphics, logos, photographs, and layout — belongs to Tinoco Painting or its licensors and is protected by intellectual property law. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, or redistribute our content without our written permission.

We work to keep this site accurate and current but do not represent that it is complete or error-free, and it is provided on an "as is" and "as available" basis. Text Messaging: Additional Terms

The text messaging consent terms set out above are the operative terms of our SMS program. The following applies in addition to them.

Opting out. Text STOP to (661) 317-2127 at any time to cancel. You will receive one final message confirming that you have been unsubscribed, and we will send no further texts to that number. Reply HELP for help.
Carrier liability. Mobile carriers are not liable for delayed or undelivered messages.
Cost and frequency. Message and data rates may apply. Message frequency varies and depends on your conversation with us.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

The mobile information you share with us, and your text messaging consent, are handled as described in our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and we will revise the "Last updated" date above. Your continued use of this website or our services after changes are posted means you accept the updated Terms.
